Welcome to Moktiv Talent! By using the Moktiv Talent app, you agree to these Terms of Use. Please read them carefully.

1. Introduction

Moktiv Talent is a platform that connects young influencers with brands for collaborations. By creating an account or using the app, you agree to comply with these Terms. These Terms may be updated from time to time, and you will be notified of any changes.

2. Eligibility

• You must meet the minimum age in your country of residence to use Moktiv Talent: 16 years in Norway, 15 years in Sweden, and 13 years elsewhere where permitted by local law. Users under 18 must have parental or guardian consent to use the app. By registering, you confirm that you meet the minimum age in your jurisdiction or that you have such consent.
• By registering, you confirm that all information you provide is truthful and accurate.
• Moktiv reserves the right to terminate your account if false information or misuse of the service is detected.

3. User Account

• Account creation: You must create a user account to use Moktiv Talent. During registration, you will be asked to provide certain information, including your email address and other necessary details.
• Account security: You are responsible for keeping your username and password secure, and you are responsible for all activity that occurs on your account.
• Account termination: You may terminate your account at any time by contacting us at henrik@moktiv.com. Moktiv reserves the right to suspend or terminate your account if you breach these Terms.

4. Payment and Assignments

• Collaborations and assignments: As a user, you may receive assignments from clients through the app. These assignments may involve payment for the services you provide (for example, promoting a product on social media).
• Payment terms: When you complete an assignment, payment will be processed through the app.
• Tax obligations: You are responsible for reporting the income you earn through Moktiv Talent to the relevant tax authorities.

5. User Responsibility

• Ethical conduct: You agree to use Moktiv Talent in a responsible and ethical manner. You shall not publish, upload, or share content that is offensive, misleading, or that infringes on the rights of other users.
• Prohibited content: It is prohibited to use Moktiv Talent to share hate speech, harassment, or illegal activities.
• Legal requirements: You must comply with all applicable laws and regulations relating to digital marketing, advertising, and data protection.

6. Privacy and Data Use

• Data collection: When you use Moktiv Talent, we collect certain information about you to facilitate collaborations and payment processing. Please read our Privacy Policy for more information.

• Limited liability: Moktiv shall not be liable for loss of income, data, or damages arising from use of the service.

9. Dispute Resolution

• Governing law: These Terms are governed by Norwegian law.
• Dispute resolution: Any disputes between the user and Moktiv shall first be attempted resolved through mediation. If mediation does not succeed, the dispute shall be decided by a Norwegian court.

10. Account Termination

• Breach of terms: Moktiv reserves the right to suspend or terminate your account upon breach of these Terms, misuse of the service, or illegal activities.
• Termination of service: Moktiv may at any time terminate or restrict access to the service without prior notice, but we will do our best to inform you in good time.

11. Transfer of Rights and Obligations

Moktiv reserves the right to transfer or assign its rights and obligations under these Terms in connection with a merger, acquisition, sale of company assets, financing, or other corporate transaction. Your rights as a user under these Terms will continue to apply following any such transfer.
